Secure Flight Program: TSA Takes Control in 2009

A federal shift in responsibility is planned: beginning in early 2009, the Transportation Security Administration will assume direct control of the Secure Flight passenger-screening program that airlines have been running.

Under the new arrangement, airlines will forward travelers’ booking details — including full name, date of birth and entries for sex and gender — to TSA, which will match that information against its watchlists.

TSA says the transmitted data will be encrypted and that records for anyone who is not a close match to an entry on the lists will be deleted after seven days.

Officials argue the added biographical detail, especially birthdates, should reduce wrongful matches at airports, since identical names are common but identical name-plus-birthdate combinations are much less so.

Civil liberties and privacy advocates have long objected to watchlist-based screening systems, citing risks to privacy, weak controls on third-party access to passenger data, and the chilling effect of government permission requirements on movement.

Past testing and rollout attempts drew sharp public criticism — from carriers’ early trials that used passenger data without clear consent to numerous reports of travelers being prevented from flying with little explanation and limited means to correct erroneous records.

TSA maintains it will offer and continue a “robust redress” process for people who believe they have been wrongly flagged.

Advocacy groups studying the final rule contend the core design remains largely unchanged from earlier proposals and note inconsistencies between the summary descriptions and the detailed regulatory text.

The Secure Flight effort itself has been delayed repeatedly: originally slated to begin in 2005, it faced critical government audits that found significant management and security deficiencies, prompting schedule slips and program overhauls.

Inspectors in 2006 criticized the program’s development practices, and while follow-up reviews in 2008 reported improvements, they also said problems persisted.

At a recent press briefing, Homeland Security leadership released, for the first time, concrete counts from TSA’s watchlists: about 16,000 people are on the “selectee” roster (subject to enhanced screening) and roughly 2,500 are on the no-fly list.

Those headline numbers exclude aliases, name variations and situational or airport-specific watchlist actions that can also trigger additional scrutiny.

The published Secure Flight regulations will take effect 60 days after appearing in the Federal Register, with implementation expected to begin soon thereafter.
